GP Placement Australia – Terms and Conditions of Business

Permanent, Fixed Contract, Exclusive & Locum Recruitment

1. Definitions and the Contract

1.1 These Terms and Conditions are between GP Placement Australia (“The Agency”) and the hirer (“The Client”), including all subsidiaries, associated companies, firms or entities seeking to engage the applicant (“The Applicant”).

1.2 These Terms are deemed accepted by the Client upon: requesting an introduction, interviewing any Applicant (in person, by phone, email, or video), receiving a CV or candidate profile, or engaging an Applicant introduced by the Agency. “Engagement” includes employment, contracting, service agreements, agency work, franchise, partnership or any other form of engagement.

1.3 All Applicant information provided by the Agency is confidential and must not be disclosed to third parties without the Agency's written consent. Passing on candidate details that lead to an engagement will incur full fees.

2. Fees and Introductions

2.1 General Fee Liability

Fees are payable for any Applicant engaged as a result of an introduction by the Agency, whether the introduction is direct or indirect.

Fees remain payable if the Applicant is engaged in any role, within one year of introduction, by an associated company, or by any party to whom the Client forwarded the Applicant's details.

2.2 Engagement of Agency Employees

If the Client engages any employee of the Agency within 12 months of that individual's introduction, the Client is liable for the full applicable fee. No rebate applies.

2.3 Permanent Doctor Placement Fees

Standard fee (full-time): $18,000 + GST.

Exclusive / High-compliance placement fee: For placements involving referrals, exemptions, Medicare provider number applications, AHPRA support, immigration steps, or other additional administration, the fee is $16,200 + GST. (The exclusive rate only applies when confirmed in writing.)

Pro-rata fee for part-time doctors: For part-time engagements, the fee is calculated as:

(Part-time hours ÷ Full-time hours) × applicable fee

Example: 20 hours/week (half-time) × $16,200 = $8,100 + GST.

Fee structure (all permanent placements):

20% payable on written acceptance of offer.

80% payable on commencement of employment.

Payment terms: 30 days.

Late payment effect: Any discount (including exclusive rates) is revoked if payment is not received within 14 days from the invoice date, at which point the full standard fee of $18,000 + GST applies.

2.4 Locum Doctor Fees

2.4.1 The Agency's fee for locum placements is 15% of the Doctor's gross wages earned during the locum assignment.

2.4.2 The fee applies regardless of shift pattern, duration, or whether the Doctor is engaged via payroll, ABN or contract.

2.4.3 Invoices are issued weekly or at the end of the assignment, whichever occurs first.

2.5 Exclusivity Clause (Only When Agreed in Writing)

When the Client signs an Exclusive Recruitment Agreement with the Agency:

– GP Placement Australia becomes the sole recruitment provider for the designated role(s).

– The Client must not engage other recruiters, platforms, job boards, or third parties for the same role(s).

– Exclusivity remains in force for 90 days or until the role is filled (whichever is earlier).

Fees applicable under exclusive arrangements include the exclusive rate ($16,200 + GST), pro-rata part-time fees, and all additional administration and referral work included.

3. Refunds, Credits and Collections

3.1 Invoices are payable within 30 days of the invoice date. Interest and recovery costs may be applied to overdue invoices.

3.2 If the account is passed to debt collection, the Client is liable for all debt recovery fees, commissions, and associated legal costs (on a full indemnity basis).

3.3 Refund schedule (permanent placements):

If the Applicant leaves within months 1–2 → 90% refund.

If the Applicant leaves within months 3–4 → 70% refund.

If the Applicant leaves within months 5–6 → 50% refund.

If the Applicant leaves from month 7 onwards → 0% refund.

3.4 Refund eligibility requires the Client to notify the Agency in writing within three (3) days of termination. The original fee must also have been paid in full and on time in accordance with the agreed terms.

3.5 Any immigration, referral, registration or similar costs prepaid or committed to on behalf of the Client remain payable by the Client and are not subject to refund.

3.6 If the placement does not commence (unless due to cancellation by the Client), all invoices are credited except for a minimum administration fee of $1,000, which will be retained by the Agency.

4. Liability

4.1 The Agency is not liable under any circumstances for any loss, expense, damage, delay, costs or compensation (whether direct, indirect or consequential) arising from: introducing any Applicant, failing to introduce an Applicant, or the engagement of any Applicant by the Client.

4.2 If the Agency is proven to be negligent, its liability is limited to the value of fees paid.

5. Variation

5.1 No variation of these Terms is valid unless in writing and signed by the Agency Director.

6. Jurisdiction

6.1 These Terms and Conditions are governed by Australian law.
